Terms of Use

Last updated: 21 October 2026

These Terms of Use (“Terms”) apply to the MasterSmith Audio website, purchased software and related services supplied by MasterSmith Audio (“MasterSmith Audio”, “we”, “us” or “our”). By downloading, installing, activating, purchasing or using our software, you agree to these Terms.

If you do not agree, do not install or use the software. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. THE MASTERSMITH AUDIO SUITE

The MasterSmith Audio Suite may include:

  • MasterSmith, including MasterSmith Rescue;
  • MasterSmith EQ; and
  • MasterSmith Fusion, when released.

Rescue is included with MasterSmith. MasterSmith EQ is sold separately or as part of a stated bundle. Fusion is a separate product and remains subject to its availability, final features, price and licensing arrangements.

Your licence covers only the product or bundle identified in your order. Buying one product does not grant a licence to any other product unless the order expressly says so.

2. SOFTWARE LICENCE — NOT A SALE OF OWNERSHIP

Your purchase grants you a limited, non-exclusive, non-transferable licence to use the purchased software under these Terms. The software itself, including its code, interface, branding and documentation, remains the property of MasterSmith Audio and its licensors.

Your licence is permanent for the version purchased, subject to these Terms and any technical compatibility limitations described below. It is not a subscription unless the offer at the time of purchase expressly states otherwise.

3. PERSONAL LICENCE

A Personal Licence permits:

  • use by one individual on up to three computers owned or controlled by that individual;
  • processing of the licence holder’s own music and music made in genuine collaboration with others; and
  • commercial release, distribution or monetisation of that music.

A Personal Licence does not permit the licence holder to provide paid mastering, restoration, EQ or other audio-processing services for unrelated third parties. It may not be shared between band members, employees, contractors or other users.

4. COMMERCIAL LICENCE

A Commercial Licence permits a named individual or business to use the purchased software to provide paid audio-processing services for third parties.

Unless an order expressly says otherwise, a Commercial Licence permits one active computer at a time. Authorised staff may use the software on that licensed computer on behalf of the licensed business. Each additional computer used simultaneously requires a separate Commercial Licence.

No per-track royalty is payable to MasterSmith Audio merely because audio was processed using properly licensed software.

5. YOUR MUSIC AND OUTPUT

You retain ownership of your audio and the output created from it. MasterSmith Audio does not acquire copyright, royalties or any other ownership interest merely because its software processed the audio.

The desktop software is designed to process audio locally on the user’s computer. It does not require users to upload their music to MasterSmith Audio for processing.

You are responsible for ensuring that you have all rights and permissions needed to use and process the audio, and for deciding whether an output is suitable for release or delivery.

6. BACKUPS AND REVIEW OF OUTPUT

Audio processing changes files. You must keep secure backup copies of original recordings and project files before processing.

You must listen to, inspect and approve processed output before publishing, distributing, replacing an original file or supplying work to a client. MasterSmith Audio is a tool and does not replace the user’s artistic, technical or professional judgement.

7. PROCESSING RESULTS AND PLATFORM ACCEPTANCE

Audio results depend on the source recording, mix, encoding history, selected settings, playback system and intended destination. Except for guarantees or promises that apply by law, MasterSmith Audio does not guarantee that:

  • a particular user will prefer a processed result;
  • processing will repair every defect or make a poor recording sound professionally produced;
  • an output will satisfy every streaming service, distributor, broadcaster, duplication plant or other third party; or
  • a third party will accept, promote or generate interest in the user’s music.

Users must check the current technical and content requirements of their intended destination.

8. MASTERSMITH RESCUE — IMPORTANT LIMITATION

Rescue is intended to reduce some audible artefacts and prepare a delivery file from audio that may have originated in a lossy format.

Lossy encoding permanently removes information. Rescue cannot recreate information that no longer exists, convert a lossy source into genuinely lossless audio, or guarantee acceptance by a platform that requires a true lossless source. A WAV or FLAC produced from a lossy source remains derived from that lossy source even though the delivery file itself uses a lossless container or codec.

9. PROHIBITED USE

You must not:

  • copy, redistribute, sublicense, rent, lease, sell or share the software or licence key except where expressly permitted;
  • allow more users or computers than the purchased licence permits;
  • bypass, disable or interfere with licence controls;
  • reverse engineer, decompile or disassemble the software, except to the limited extent that applicable law expressly permits and does not allow that right to be excluded;
  • remove copyright, trade mark, attribution or licence notices;
  • use the software unlawfully or to infringe another person’s rights; or
  • falsely claim that MasterSmith Audio endorses the user, their business or their music.

10. PRICES, PAYMENT AND TAXES

Prices are displayed in the currency stated at checkout. Unless clearly stated otherwise, website prices are in Australian dollars (AUD).

Payments may be processed by a third-party payment provider. That provider may apply its own terms and privacy policy. MasterSmith Audio does not receive or store complete payment-card details when payment is handled entirely by the provider.

The customer is responsible for any taxes, duties, currency-conversion costs or bank charges that apply to the purchase, except where MasterSmith Audio is legally required to collect or pay them.

11. UPDATES, MAJOR VERSIONS AND COMPATIBILITY

A purchased licence includes updates released for the purchased major version. A future major version may be offered as a separate paid upgrade.

MasterSmith Audio may correct faults, improve performance, alter features or discontinue obsolete functions in updates, provided this does not remove rights that apply under law.

Computer hardware, operating systems, drivers and third-party components change over time. We do not promise that an older software version will remain compatible with every future system. Where reasonably practical, compatibility information and supported system requirements will be published or provided before purchase.

12. THIRD-PARTY COMPONENTS AND SERVICES

The software may contain third-party components governed by their own licence notices. Those notices form part of the software documentation or installation materials where required.

Links, embedded media and external services on the website—including payment, video, hosting and communication services—are operated by third parties. Their availability and conduct are outside MasterSmith Audio’s direct control.

13. REFUNDS AND CONSUMER GUARANTEES

Refunds and other remedies are handled in accordance with the MasterSmith Audio Refund Policy and applicable law.

Under the Australian Consumer Law, goods and services may come with consumer guarantees that cannot be excluded. Depending on the circumstances, a customer may be entitled to a repair, replacement, refund, cancellation or compensation where those guarantees are not met.

A change of mind, failure to read published system requirements, or dissatisfaction arising solely from personal taste will not automatically create a refund entitlement where the software operates as described. This does not limit any remedy available under applicable law.

14. SUPPORT

Reasonable support is provided through the contact method published on the MasterSmith Audio website. Support does not include audio production, mix engineering, computer repair, recovery of lost files, or training unrelated to the software.

We may ask for relevant technical information needed to investigate a fault. Do not send confidential music or project files unless specifically requested and you choose to do so.

15. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, MasterSmith Audio is not liable for indirect, incidental or consequential loss arising from use of the software, including lost profits, lost opportunities, lost data or loss caused by releasing an output without checking it first.

Where the law permits liability to be limited, MasterSmith Audio’s liability may be limited, at its option, to supplying the software or service again, repairing it, or paying the reasonable cost of having it supplied or repaired again. This limitation does not apply where it would be unfair, unreasonable or unlawful, or where a different remedy is required by law.

16. SUSPENSION AND TERMINATION

MasterSmith Audio may suspend or terminate a licence for a material breach of these Terms, including deliberate licence sharing, unauthorised redistribution or circumvention of licensing controls. Where appropriate, we will give notice and a reasonable opportunity to remedy the breach before termination.

Termination ends the right to use the software but does not transfer ownership of the customer’s music or previously created output to MasterSmith Audio. Terms concerning ownership, payment, prohibited redistribution, liability and dispute resolution continue where their nature requires it.

17. CHANGES TO THESE TERMS

We may update these Terms to reflect product, business or legal changes. The current version and its revision date will be published on the website.

Changes will not retrospectively remove a licence already purchased or any right that cannot lawfully be removed. Continued use after notice of a change constitutes acceptance only to the extent permitted by law.

18. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Australia and the applicable laws of the Australian state or territory in which MasterSmith Audio operates, without excluding any mandatory law that applies in the customer’s location.

If a dispute arises, please contact MasterSmith Audio first and provide enough detail for us to investigate. Both parties agree to attempt to resolve the matter reasonably and in good faith before commencing formal proceedings, except where urgent relief is required or the law gives an immediate right to act.
